Terms of Service

About these terms

These terms apply when you hire BunkWise Technologies ("BunkWise", "we", "us") to design or build a website, or to run a monthly SEO plan. BunkWise (OPC) Private Limited is being incorporated; until it is, services are provided by its founder, Madhav, trading as BunkWise Technologies, and your agreement carries over to the company once it is incorporated.

By paying the first instalment or confirming a quote in writing (including on WhatsApp, Telegram or email), you agree to these terms. If your written quote says something different from these terms, the quote applies.

1. Quotes and scope

Every project starts with a written quote that sets out the package, pages, features, price and expected timeline. Prices published on our website are the starting price for each package; your quote confirms the final scope.

A quote is valid for 30 days. Work outside the agreed scope, such as extra pages, new features or a change of direction after you approve the design, is quoted separately, and we will not start it until you agree.

2. Payment

Website projects are paid in three instalments:

40% to start the project;
40% when you approve the preview;
20% before the website goes live or the files are handed over.

Monthly SEO plans are paid at the start of each month. Prices in India are exclusive of GST, which is added where it applies. Clients outside India pay in the currency on their quote; bank, transfer and currency-conversion fees, and any local taxes in your country, are your responsibility. If a payment is overdue, we may pause work until it is made.

3. Cancellations and refunds

The first instalment is non-refundable once research or design work has begun, because it pays for work already done.
If you cancel after approving the preview, the second instalment is also non-refundable. Once the amounts due are paid, we will hand over the work completed so far.
If we cannot complete your project for reasons on our side, we will refund what you paid for work we have not delivered.

4. What we need from you

You are responsible for giving us accurate business information, and text, photos, logos and other material that you own or have permission to use. You also agree to give feedback within a reasonable time.

Our timelines depend on receiving content and feedback, and they pause while we wait. If a project has had no response from you for 60 days, we may close it; restarting it may need a new quote.

5. Timelines and revisions

Delivery times on our website and in your quote are estimates, not guarantees. You can ask for changes to the preview within the revision rounds stated in your quote. Changes that alter the agreed scope after approval are new work under section 1.

6. Domains, hosting and other third-party costs

Unless your quote says otherwise, costs charged by other companies, such as domain names, hosting, business email, paid plugins, fonts, stock photos and advertising, are paid by you, and those accounts should be in your name. We are not responsible for outages, price changes or policy changes made by those companies.

7. Ownership and our portfolio

Once you have paid in full, you own the design, the content we wrote for you and the code made specifically for your website. Until then, ownership stays with us. We keep the right to reuse our general methods, tools and code that is not specific to your business. Third-party items such as fonts, images and libraries remain under their own licences.

We may show your live website and screenshots of it in our portfolio and marketing, unless you ask us in writing not to.

8. SEO, AEO and GEO results

Search engines and AI assistants decide what they rank and recommend, and they change their systems often. We do the technical, content and local work that gives your website the best chance, and we report on it honestly, but we cannot guarantee any ranking, amount of traffic, number of enquiries or mention in AI answers such as ChatGPT or Google AI Overviews.

9. Monthly SEO plans

Monthly plans run month to month from the first payment. You can cancel with 30 days' notice; the month you have already paid for is not refunded. Each plan includes the work listed for it on our website or in your quote, and unused work does not carry over to the next month.

10. After launch

If something we built does not work as agreed, tell us within 30 days of launch and we will fix it at no extra cost. Later changes, new content and ongoing improvements are covered by a monthly SEO plan or quoted separately.

11. Confidentiality

We keep your business information, account access and unpublished material confidential, and use them only to deliver your project.

12. Limitation of liability

Our total liability for a website project is limited to the amount you paid us for that project, and for a monthly plan, to the fees paid in the previous three months. We are not liable for indirect losses such as lost profits, lost data or lost business opportunities. Nothing in these terms limits any liability that cannot legally be limited.

13. Governing law and disputes

These terms are governed by the laws of India. If a disagreement arises, we will first try to resolve it with you in good faith for at least 30 days. If that fails, it will be decided by the courts with jurisdiction over BunkWise's registered office in India.

14. Changes to these terms

We may update these terms from time to time; the date at the top shows the latest version. The version in force when you accepted your quote applies to that project.
