Texas taxes website creation

This is the part most out-of-state guides miss. In a 2024 letter ruling (No. 202404008L), the Texas Comptroller treated the creation and maintenance of a website as a data processing service, which is taxable in Texas. The Sales Tax Institute's summary quotes the reasoning: building and maintaining a site "involves the compilation, storage, and manipulation of data." Pure planning or design blueprints and consulting were treated as non-taxable.

There is a partial break: under Section 151.351 of the Texas Tax Code, 20% of the value of data processing services is exempt, so sales tax applies to 80% of the price. On a $5,000 website, tax is charged on $4,000. When you compare quotes, check whether a Texas provider has added this tax, and whether a lower quote simply leaves it out.

Privacy: the TDPSA exempts most small businesses

The Texas Data Privacy and Security Act took effect on July 1, 2024. As Davis Wright Tremaine explains, it has no revenue threshold; instead it exempts businesses that meet the SBA's definition of a small business, except that even they must get consumer consent before selling sensitive personal data. For most local service businesses, a clear privacy policy and sensible form handling are what the website needs.
